Actress Overcome with Emotion During Major Court Decision

Melissa Gilbert was visibly moved in a New Mexico courtroom as a judge ruled that her husband, actor and director Timothy Busfield, would be released before trial under strict conditions.

Judge David Murphy ordered Busfield’s release on his own recognizance, requiring him to appear at all court proceedings and comply with court-imposed restrictions. The decision came over objections from prosecutors.

As the ruling was announced, Gilbert was seen wiping away tears. Busfield will be monitored by pretrial services and must adhere to multiple limitations while awaiting trial.

These conditions include abstaining from alcohol, illegal drugs, and firearms, avoiding contact with witnesses, and having no interaction with minors. He must also notify the court of any change in residence. A trial date has not yet been scheduled.

Prosecutors had argued that Busfield should remain in custody, raising concerns about alleged prior behavior and questioning whether he would comply with court orders. They also cited a previous accusation from another actress and delays surrounding his surrender after a warrant was issued.

Despite those arguments, Judge Murphy determined that supervised release was appropriate based on the circumstances presented to the court.

According to court records, Busfield recently completed a psychological evaluation that assessed him as low risk. The judge also reviewed letters of support from family and colleagues, including Gilbert, who described him as caring and reliable. Busfield has denied all allegations and says he intends to fight the charges as the case moves forward.
